This Terms of Service (“TOS”) is provided as an agreement between you and the THEBITMASTER INCwith business address at 500 4 Ave SW #2500, Calgary, AB, Canada T2P 2V6 (herein as “THEBITMASTER INC”) in relation to your access to this website (“Website”) and use of any of the services provided through it, including if you subscribe to our cryptocurrency, forex, or stock signal Telegram channel; purchase any cryptocurrencies from us; or shop from our e-commerce store(each a “Service” and collectively, our “Services”).

You are expected to read the entirety of this TOS (and other agreements available through our Website, which are incorporated here by reference) and understand and agree to it before using our Services.

By accessing this Website and/or using any of our Services, you confirm and agree with the terms in this TOS. If you do not agree with this TOS, your only option is to refrain from using our Services.

  • THEBITMASTER INCSERVICES

THEBITMASTER INC provides a platform for different customers/users (“you” or “your”). We majorly deal with cryptocurrencies, including selling to buyers and offering stock, forex, and crypto Signals through our Telegram channel. We also have a section for the sale of Clothing, Bedsheets, Accessories, Slippers and Flip Flops, Carpets and Rugs, and other items available through the “Shop” section of the Website. Aside from these listed Services, we do not provide any other services through the Website.

When you use some of our Services, additional terms and conditions may apply, in which case, you’ll have to comply to use such Services. If any additional terms and conditions conflict with this TOS, the additional terms and conditions will prevail.

  • NO INVESTMENT OR FINANCIAL ADVICE

Any information provided on the Website and our Telegram channels regarding cryptocurrency, stock, and forex Signals is provided for educational purposes only and must not be construed as investment or financial advice.

Trading in cryptocurrencies and forex involves a high level of risk, which may not favor all investors. You are expected to carefully consider your investment experience, objectives, and risk appetite before trading. You should not engage in trading with money you cannot afford to lose. Like other investments, the outcome of your trade may yield profit or loss. You are expected to seek independent professional financial and investment advice before trading if you are doubtful. The previous performance of a market does not determine the future performance.

THEBITMASTER INC shall not be responsible or liable to you or any third-party for any loss suffered as a result of the information about cryptocurrencies, forex, and stock provided to you on our Telegram channel or anywhere on the Website. By subscribing to our Signal Telegram channel, you acknowledge that THEBITMASTER INC only provides information for educational purposes only and that any trade you carry out based on any information received from us will be solely based on your decision. We are not aware of the money you trade with or the level of risk associated with each trade.

In order to use any of our Services, you will be required to submit certain personal information, which is used to provide the applicable Service, communicate with you, gather analytics, improve the Website, secure the Website, and comply with our legal obligations. All the designs, graphics, logos, scripts, button icons, page headers, and service names on the Website are registered trademarks and trade dress of THEBITMASTER INC in Canada and other locations. Our trademark and trade dress may not be used – including as part of domain names – in connection with any service or product in a manner that is likely to cause confusion. Our trademark and trade dress may not be copied, imitated, or used (in whole or part) without THEBITMASTER INC’s prior written approval.

  • LICENSE GRANT

Subject to your compliance with this TOS and other referenced agreements, THEBITMASTER INC grants you a limited, non-transferable, non-exclusive, non-sublicensable license to access and use the Website and our Website Content for your personal, non-commercial use. The license granted to you hereunder does not include any (i) commercial use or resale of our Services or our Website Content, (ii) copying of our product image, descriptions, pricing, or listing, or any derivative use of our Services or Website Content, (iii) use of any robots, data mining, or other data-gathering and extraction software. We reserve and retain all rights not granted to you under this TOS.

You may not:

  1. Duplicate, resell, visit, or exploit our Services for any commercial endeavors without express written approval from THEBITMASTER INC;
  2. Frame or utilize framing techniques on any of our trademarks or other intellectual property without our written approval;
  3. Misuse our Services; or
  4. Use our Services or the Website in any manner that goes against any and all applicable laws.

THEBITMASTER INC reserves the right to terminate this license and your use of our Services at any time if you refuse to comply with this paragraph and this TOS in whole.

  • USER ACCOUNT

In order to use some of our Services, such as placing an order through our store, you may be required to create a user account and submit personal information to us (such as your name, email address, shipping address, and payment method). It is your responsibility to maintain your account’s confidentiality and any activities that occur under it.

By submitting the personal information requested by THEBITMASTER INC during your registration, you hereby warrant that your information is accurate, complete, and correct and that you will update your information if the need arises. We reserve the right to refuse your registration information, as well as terminate your user account if we, at our discretion, believe that your information impersonates a third-party or is otherwise incomplete or incorrect.

  • REVIEWS AND OTHER USER-GENERATED CONTENT

The Website may provide you with the ability to submit user-generated content, especially reviews – as long as it is not obscene, illegal, defamatory, threatening, or unethical. We reserve the right to review and remove any content that we believe violates this paragraph or any ethical standard.

By submitting reviews (or any user-generated content), you hereby grant THEBITMASTER INCan irrevocable, non-exclusive, royalty-free, sublicensable right and license to publish, translate, perform, distribute, create derivative works, advertise, modify, reproduce, and publicly display such user-generated content in any media known to us. THEBITMASTER INC assumes no responsibility for any user-generated content you submit on the Website. You hereby agree to defend, indemnify, and hold us harmless for any and all claims from third parties in relation to your user-generated content. 

  1. FEES AND PAYMENTS

To use most of our Services, including to gain access to the applicable Signal channel, purchase items from our store, and purchase cryptocurrency, you will be required to make a payment by adding a payment method such as a credit card or PayPal emailand/or by transferring the equivalent amount through INTERAC e-Transfer orBitcoin (BTC). Your method of payment depends on the Service you are paying for. For example, to subscribe to our Signal channel, you will be required to transfer the applicable fee to our BTC wallet, which will be provided on the payment page.

Any action to use our Services represents an offer from you, which we have the discretion to accept or reject. Your offer to use any of our Services will be accepted when we provide the Service to you. For example, your offer to subscribe to any of our Signal channels shall be deemed accepted when we receive your payment and add you to the applicable Signal channel.

  1. PRICING AND ERRORS

The prices of our Services are available through the applicable Service page. Our Services pricesare listed in USDand areinclusive of applicable tax (unless stated otherwise). However, items in our store are exclusive of the relevant shipping fees and other handling fees. The whole amount to pay for a Service shall be listed on the checkout page. THEBITMASTER INC reserves the right to increase or change any Service price at any time. However, any increment or changes shall not affect any Service already paid for before such an increment was made.

On certain occasions, the Website may list prices of our products and Services in error as a result of human or machine mistakes. THEBITMASTER INC reserves the right to correct any errors, even at the point of purchase. In this case, we will notify you, and you can decide on whether to cancel or continue your purchase at the original price.

  1. SHIPPING AND DELIVERY

For purchases made from our store, we will process and dispatch your order within 1 to 3 days upon the confirmation of your payment. It is your duty to submit an accurate shipping address on the order checkout page or via your user account. We or any courier partner will not be liable for any loss due to a wrong shipping address.

The shipping fee and delivery date applicable to your order depend on the distance of your location. While items within Canada have a flat shipping fee of $10, other locations will be calculated and provided to you on the checkout page based on the distance.

  1. CANCELLATIONS AND REFUNDS

Generally, you may cancel any of our Services before we charge your payment method.

  1. Order cancellation: You may cancel any order placed for items in our store, provided your payment method has not been charged. Once we charge your payment method, cancellation or refund may not be possible at that point. However, you may request cancellation, refund, or exchange if you find out that the item delivered to you (or any item in your order) is damaged, wrong, or missing. In such cases, your request to cancel and get a refund or exchange will only be valid if the item is in its original packaging, unused, and in its original condition (this does not limit your right of inspection).
  2. Signal channel subscription: We do not offer refunds when you subscribe to any of our Signal channels. Upon subscribing to any Signal channel, your subscription automatically cancels when your subscription period elapses.
  3. Cryptocurrency purchase:Please, ensure you are sure of your intent to purchase any cryptocurrency from us. Once you send the equivalent amount to our wallet address, cancellation will not be offered from that point.
  1. TITLE AND RISK OF LOSS

Upon successfully delivering of any of our Services, specifically, any items ordered from our store, the title and risk of loss automatically pass to you.

  1. CUSTOMS DUTIES

If you purchase items in our store from outside of Canada, you may be subject to customs duties, which may be imposed by the government of your location upon your order getting to your country. THEBITMASTER INCdoes not have control over such fees. Please, review the information source about these fees in your country before placing an order on the Website. 

  1. TERMINATION OF USE

You have the right to terminate your use of our Services or delete your user account at any time without notice. You can delete your user account by using the “delete my account” button on your user account area.

THEBITMASTER INC reserves the right to terminate your use of our Services at any time without liability, including if we believe your use violates this TOS, your representations and warranties, any applicable law, statute, regulation, or ordinance.

WE MAKE NO WARRANTIES ABOUT THE ACCURACY, RELIABILITY, CURRENTNESS, AND COMPLETENESS OF THE WEBSITE AND OUR SERVICES, INCLUDING THE WEBSITE CONTENT, OR THAT THE WEBSITE WILL BE ERROR-FREE OR WITHOUT BUGS OR OTHER HARMFUL SOFTWARE.

WE DO NOT WARRANT TO YOU THAT OUR SIGNAL SERVICES WILL MEET YOUR EXPECTATIONS OR GENERATE REVENUE, OR THAT YOU WILL NOT LOSE ANY MONEY WHILE USING OUR SIGNALS.

YOU AGREE THAT THE WEBSITE OR SERVICES MAY BE DELAYED BY CIRCUMSTANCES BEYOND OUR REASONABLE CONTROL. YOU ALSO AGREE THAT NO METHOD OF INFORMATION SECURITY OVER THE INTERNET IS 100% SECURE.

DUE TO THIS, UNDER NO CIRCUMSTANCES WILL THEBITMASTER INC (OR ANY INDIVIDUAL OR COMPANY AFFILIATED WITH US) BE LIABLE TO YOU OR THIRD-PARTY FOR ANY INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, CONSEQUENTIAL, OR SIMILAR DAMAGES, INCLUDING BUT NOT LIMITED TO, DAMAGES OF LOSS OR PROFIT, REVENUE, DATA, TIME, INFORMATION, OR OTHER FINANCIAL AND INTANGIBLE LOSSES SUFFERED AS A RESULT OF YOUR RELIANCE OR USE OF OUR SERVICES AND ACCESS OF OUR WEBSITE OR WEBSITE CONTENT, EVEN IF THEBITMASTER INC HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

NOTWITHSTANDING THE ABOVE, IF THEBITMASTER INC IS FOUND TO BE LIABLE BY APPLICABLE LAW, ITS LIABILITY SHALL NOT EXCEED THE GREATER OF THE FEES YOU PAID TO US IN THE PAST 3 MONTHS OR A FLAT FEE OF $100.

CERTAIN LOCATIONS OR JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IF THESE LOCATIONS OR JURISDICTION APPLIES TO YOU, SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU, AND YOU MAY HAVE ADDITIONAL RIGHTS.

  1. INDEMNITY

You hereby agree to defend, indemnify, and hold THEBITMASTER INC (and any individual or company affiliated with us) harmless from and against any losses, damages, claims, injuries, complaints, disputes, issues, demands, or expenses (including reasonable attorney’s fees) that may be made by any third-party as a result of your use of our Website or Services, our Website Content, your breach of this TOS or any applicable law, regulation, statute, or rule, or violation of any third-party rights.

(not applicable to users in Quebec) This TOS and any dispute arising out of your use of our Services shall be governed and construed in accordance with the laws of the Province of Alberta and the federal laws of Canada applicable therein without regard to conflict of law and its provisions. You hereby agree to bring any dispute to the courts located in the Province of Alberta.

  • ASSIGNMENT

You may not assign the rights granted to you under this TOS to a third-party without written permission from THEBITMASTER INC. However, THEBITMASTER INC, on the other hand, reserves the right to assign its obligations or rights under this TOS to third parties without consent and liability.

  • WAIVER

A failure of THEBITMASTER INC to enforce a right or provision under this TOS shall not operate as a waiver of its right to enforce such a right or provision at another time or on subsequent or similar violations. No waiver shall be valid under this TOS unless it is writing.

  • FORCE MAJEURE

If THEBITMASTER INC delays or fails to carry out its obligations under any of its Services as a result of circumstances beyond its reasonable control (such as pandemics, earthquakes, war, riots, government actions, etc.), THEBITMASTER INCshall not incur any liability.
